Declarations, Covenants, Conditions, & Restrictions (DCCRs)

Hampton Lakes is a deed-restricted community and the DCCRs are the governing rules of the Homeowner Association (HOA). When purchasing a property in Hampton Lakes, you will sign a legally binding document agreeing to comply with the DCCRs. This also applies to all homeowners who lease their property to either long or short-term tenants and are responsible for ensuring that their tenants are fully aware and comply with the deed restrictions of the community. The DCCRs cover many aspects including:

  • Property use

  • Parking and prohibited vehicles

  • Keeping pets

  • Maintenance and enhancement of property etc. 

If you violate the DCCRs, you could face various penalties, including fines.

Below is a summary of some specific use restrictions contained in the DCCR governing documents The complete list of use restrictions are located in Exhibit "C." of the DCCRs. This is available to homeowners only, and non-homeowners should contact their landlord to obtain details.

Short-Term Rental & Leasing Your Property

Short-term property rentals of less than four (4) nights is not permitted within the community. Each property must be rented in its entirety. Single rooms rentals (sometime known as rooming houses) are not allowedManagement Companies must register with Don Asher Management by emailing their management agreement to ksadmin@donasher.com

 

Restricted Vehicles

Commercial vehicles, trailers, boats, mobile homes, golf carts, other recreational and inoperable vehicles must be stored in garages and are not permitted on driveways or roads within the community. The DCCRs define commercial vehicles as "as any vehicle with commercial writing on their exterior or vehicles primarily used, designed or registered for a commercial purpose and vehicles with advertising signage attached or displayed on such vehicles exterior".

 

Home Based Businesses

It is not permitted to operate any business from a home within the community, with the exception of a

home office. The DCCRs define a business as "shall have its ordinary, generally accepted meaning and shall include, without limitation, any occupation, work, or activity undertaken on an ongoing basis which involves providing goods or services to persons other than the family of the producer and for which the producer receives a fee, compensation or other form of consideration, regardless of whether [A] such activity is engaged in full or part time; [B] such activity is intended to or does generate a profit or [C] a license is required".

Pets

The DCCRs state that a reasonable number of dogs (except that no Pit Bulls are allowed), cats, or other household pets of the nature commonly sold in pet stores may be permitted in a lot (not to exceed three (3) such pets). Also bylaws concerning responsible dog ownership, including but not limited to keeping dogs on a leash when outside the dwelling and the person walking the dog shall clear up after it. The fact that Polk County does not have a leash law does not override the HOA's DCCRs. Those wanting to exercise their dog off-leash can do so outside the community. Northeast Regional Park, just north of US27 has a spacious dog park. Homeowners and their tenants must comply with the DCCRs, failure to do so will result in enforcement action being taken.

Parking

Parking enforcement began on August 1, 2023, from midnight to 6:00 am every night. A towing company is contracted to place a sticker on any vehicle parked on the street. This sticker is notification that the vehicle cannot be parked on the street and can be towed. Those vehicles are subject to towing the next night if found parked on the street again. The HOA receives no fees or compensation from the towing of vehicles. We are hopeful that this will resolve all issues with parking on our streets. However, the board will consider expanding the hours of towing if parking on our streets remains problematic, especially if emergency vehicles cannot get through to any house in a timely manner.


The DCCRs state that "parking of any vehicles on streets or thoroughfares, and parking of commercial vehicles or equipment, mobile homes, campers and similar recreational vehicles, golf carts, boats and other watercraft, trailers, stored vehicles, or inoperable vehicles in places other than enclosed garages, except temporarily during loading and unloading: however, construction, service, and delivery vehicles shall be exempt from this provision for such period of time as is reasonably necessary to provide service or to make a delivery to a Lot or the Common Area".​

Architectural Review Committee (ARC)

All architectural and landscape changes to your property must be approved by the Architectural Review Committee before work is started. The application form is available on the ARC committee page. Once completed this should be emailed to arc@hamptonlakes.net and will be reviewed at the next monthly ARC meeting. Most applications that fall within the community guidelines will be approved, but the process creates reasonable controls to maintain standards throughout the community. Such changes would include but are not limited to the following:

  • Painting or changing the external color of the home

  • Other changes to the external appearance

  • Installing a privacy fence

  • Replacing roof and/or installing solar panels

  • Installation of guttering

  • Landscaping

  • Driveway widening

Making modifications to your property without approval can result in fines and remediation costs.
